Notice and Takedown Policy and Procedure

The National Library of Wales (NLW) aims to provide the widest access to our collections and services. In doing so we take reasonable steps to ensure that information (which can be in any form, including text, images, audio and video) we publish online does not cause harm or offence, and we strive to act at all times in good faith and in accordance with legislation.

If you are concerned that you may have found information that breaches copyright, contravenes privacy laws, or is obscene or defamatory, please contact us in writing. Your complaint can either be sent electronically to takedown@llgc.org.uk or by letter, marked ‘URGENT’, to Enquiries Service, The National Library of Wales, Aberystwyth, Ceredigion, SY23 3BU. Please state the following:

  • Your contact details.
  • A description of the material, including the exact catalogue reference and full URL of the webpage, for us to identify the relevant item(s).
  • The nature of your complaint, and reason for notifying us.
  • If your complaint concerns intellectual property rights, confirmation that you are the rights holder, or an authorised representative of the rights holder.
  • If your complaint concerns libel, defamation, confidentiality or personal data, confirmation that you are either the publisher or the subject of the material in question, or their authorised representative.

The Notice and Takedown procedure

  1. We will acknowledge that we have received your complaint within 5 working days and proceed in accordance with our Complaints Policy.
  2. Access to the material will be removed from our websites while the complaint is investigated.
  3. We may contact third parties to inform them that the material is subject to a complaint and under what allegation.
  4. We will communicate with the parties concerned with the aim of resolving the issue swiftly and amicably and to the satisfaction of all parties. This discussion may result in one the following outcomes:
    a. The information is restored on NLW website(s) unchanged.
    b. The information is replaced on NLW website(s) with changes.
    c. The information is permanently removed from the website(s).
    d. If the parties concerned are unable to agree a solution, NLW will decide whether the information is restored on the website(s) or remains unavailable until a time when a resolution has been reached.
